Construction accident Death in Farmington CT leads to Wrongful Death Lawsuit


The construction accident death of a young man , struck by a steel Beam that fell upon him which had not been properly secured into its concrete pocket was initially investigated by Federal OSHA last year. OSHA rendered findings that would support a finding of negligence on the part of the Builder MJM Carpentry. A deeper level of investigation, however, conducted by the Estate of the Decedent's Legal Counsel, Law Offices Of Paul Levin, has now resulted in the imminent filing of a Lawsuit against the general contractor along with the Developer and related individuals associated with the decision and profit making enterprise.

NEW HAVEN, CT PEDESTRIAN STRUCK BY A POLICE VEHICLE CRIES FOUL WHEN JUNIOR OFFICERS ARE PUT IN CHARGE OF ACCIDENT INVESTIGATION


Sometimes, unlikely events occur. Getting struck by a police cruiser on a street just blocks from the Police Department falls into that category. Having the Assistant Police Chief( Officer Melendez) behind the wheel at the time adds to the misfortune. Losing consciousness at the scene and being removed by ambulance with head and facial injuries only to awake from the fog of it all to find out that the accident investigation is likely being carried out by officers, junior in rank to the Assistant Chief with no evident referral to the State Police or some other mechanism offering a higher indicia of reliability as to the eventual findings and investigative deliberative process borders on the incomprehensible. That, however, is exactly what seems to have happened in the case of a recent client whose Family simply contacted my office to look into what may have happened and take any appropriate steps to pursue a personal injury claim on his behalf should the facts so warrant.

Implications of Injury and Medical Malpractice Tort Reform

In today's difficult economic and business environment, it is easy to imagine movement in many States, including Connecticut, towards reforming or capping the level of compensatory damages which victims of medical negligence or other serious injuries are entitled to. The appeal behind the idea of adopting this type of legislation it twofold. First, that by lowering the financial exposure which manufacturers of products and service providers such as Hospitals and physicians may have, the monies which would otherwise have to paid out to those injured could be passed on to consumers thus lowering the price for everyone else. Secondly, that the cost associated with paying for higher insurance premiums would be reduced and result in further cost savings which, in theory, could be passed along as price reductions as well.
